Learning Outcomes of the course unitBy the end of the course, the students should be able to:
  1. Define the rules of law applicable in connection with the Public Administration.
  2. Describe and evaluate the principles governing the action of the Public Administration.
  3. Distinguish and define the concept of administrative act, and its’ revisional control by the Supreme Court.
  4. Identify and implement the basic provisions of the Legislation with which the Family Law is in line with the principles of equality between the sexes and defense of interest of the child.
  5. Distinguish and record the jurisdiction and power authority of Family Courts.
  6. Identify and explain the family rights and duties as they are protected and ordered of the key provisions of the Family Law.
  7. Designate, describe and explain the key provisions of Family Law and of the relevant case law.
  8. Recognize and evaluate the role and functions of welfare officers as defined in the Act, in relation to the legal relations of the family.

Course Contents·  Principles of Justice. Law and Resources of Law, The Constitution of the Republic, the principle of separation of powers, principles governing the action of the Public Administration, the executory act, the competence of administrative organs, management control of the Supreme Court, Reasons for annulment.
·  Constitution and Family Law. The right to respect the privacy and family life, the right to marry.
·  Introduction to Family Law. Definition of family law, the categories of family relationships, the definition of family, the importance of law and its characteristics.
·  The amendment of Article 111 of the Constitution. Historical review, changes to the amendment, the Family Courts, jurisdiction, decisions, appeals.
·  Parental Control. Meaning of parenting, historical evolution, holders, principles that govern it, content, the criterion of application, the criterion of judgments, the administration use of the property of the child, the consequences of bad exercise of parental control, the criteria of evaluation of the  interest, welfare of the child, the negative criteria, the role of labour officer and the nature of the appointment, the opinion of a child, access of parent to the child, nature and purpose of the right to communicate, the criterion, case law.
·  Maintenance order. Maintenance order of minors, maintenance order of children into adulthood, and measure contents, the calculation of maintenance, the maintenance obligation of parents of adult children, the termination of the right for maintenance order, case law.
·  Adoption. Meaning of adoption, adoption conditions, requirements, consent to adoption, criteria for issuing decree of adoption, the welfare officer's commitment, the binding nature of the finding to the Court, tasks and duties of welfare officer, the effects of adoption, the case law.
·  Divorce. The Constitution and the grounds for divorce, the reason of irretrievable brake down of the marriage, the reason of the four-year separation.
·  Participation in fortune. Claim to the increase, the meaning of "fortune" and "contribution", presumption, loss of right to bring actions.
·  Violence in the family. Definition of family violence, the restraining order, injunction blocking conditions, shelter - the establishment and operation.
